The BWCA Is Protected, Again

Yesterday morning, Gov. Tim Walz signed an executive order banning mining near the Boundary Waters Canoe Area. Environmental groups are lauding the decision, and litigation from mining interests is possible. [Minnesota Reformer]

• How the ban works: Earlier this year, Rep. Pete Stauber was successful in passing a bill to lift a Biden-era federal ban on mining near the BWCA. With the federal ban lifted, mining companies would still need to get permission from Minnesota regulators to start digging. Walz' executive order directs the Minnesota Department of Natural Resources not to grant mining permits in the Rainy River Watershed, which is the site of the BWCA. [Minnesota Reformer]
• BWCA on the ballot: November's election will play a big role in whether or not this policy sticks, as the executive order will expire 90 days after Walz leaves office. Republican candidate Lisa Demuth said she would work to "ensure mining is part of Minnesota’s future," and DFL candidate Amy Klobuchar has yet to comment at the time of writing. Walz has also directed state officials to start drafting legislation to permanently protect the BWCA from mining, and the makeup of the state legislature after November is sure to impact how successful a permanent ban will be. MN vs. TX: Minnesota is suing Texas Gov. Greg Abbott over the delayed extradition of an ICE agent charged with shooting Julio Sosa-Celis in North Minneapolis and lying about it. ICE agent Christian Castro has been sitting in a Texas jail since May 29 after Hennepin County Attorney Mary Moriarty had put out a nationwide warrant for his arrest. If Castro is not extradited by Aug. 26, he will become eligible for release, according to Texas law. [Star Tribune]

Gone fishin': A federal judge dismissed a lawsuit from the federal government seeking access to Minnesota's voter rolls. U.S. District Judge Katherine Menendez called the DOJ's lawsuit a "fishing expedition" and dismissed the case on the grounds that the government can't use a lawsuit as an excuse to seek evidence when no violation has been alleged.
